Safety Coalition Sues FMCSA Over Hours-of-Service Rules

coalition of safety-oriented groups filed a lawsuit against the Federal Motor Carrier Safety Administration, asking the U.S. Court of Appeals for the District of Columbia Circuit to review the truck driver hours-of-service rules the agency issued in April.

The groups — Public Citizen, Citizens for Reliable and Safe Highways, and Parents Against Tired Truckers — claimed that the rules failed to meet requirements Congress set in 1995.

“The rules issued by FMCSA don’t meet the requirements” of the 1995 law abolishing the Interstate Commerce Commission, Public Citizen spokeswoman Shannon Little said in an interview with Transport Topics.



The law contained a provision directing the Federal Highway Administration, which was in charge of truck safety at the time, to issue rules by March 1996 addressing truck driver fatigue issues.
