Gazeta Mercantil Online (09/21/99); Arruda, GuilhermeCommonwealth Court; Workers' Compensation
In the case of Schneider National Carriers v. Workers Compensation Appeal Board, the Pennsylvania Commonwealth Court agreed with the decisions of a workers' compensation judge and the WCAB that one of the carrier's owner-operators was in fact an employee and thus entitled to workers' comp benefits.Although there was an agreement that the original claimant was an independent contractor, the court pointed to other aspects of the carrier's and claimant's relationship that it said show the carrier's control. For example, the employer required equipment inspections and log books, gave the claimant a fuel credit card, and made the claimant take its physical and drug tests.
The carrier also took funds from his paychecks to cover the National Association of Independent Truckers' on-the-job accident program, in which it entered him. While the employer said some of these arrangements were due to federal requirements, the court did not accept this argument, citing its ruling in Universal Am-Can Ltd. v. WCAB.
