ATA Cites ‘Misleading’ Claims In HOS Opponents’ Arguments

transportation industry coalition defending the federal driver hours-of-service regulation said consumer and labor groups challenging the rules made misleading statements and misinterpreted data in arguments they made in court.

In a brief filed with the U.S. Court of Appeals for the District of Columbia, the industry group — which includes American Trucking Associations — said the HOS opponents, did “themselves a disservice, and unfortunately set the tone for much of the rest of their argument, by opening their brief with misleading atmospherics.”

Public Citizen, along with several other consumer-advocacy and labor groups, sued FMCSA over its August 2005 revision of the HOS rule, arguing it did not properly account for drivers’ health and it did not do enough to reduce driver fatigue. It filed its brief in June
