Appeals Court Rejects Delaware Toll Suit

federal appeals court ruled that several trucking groups, including American Trucking Associations, did not have the legal standing to challenge a toll increase on several bridges linking New Jersey and Pennsylvania, the Associated Press reported Friday.

The Third Circuit Court of Appeals ruled Thursday that ATA could not sue the Delaware River Joint Toll Bridge Commission over a toll increase proposed in 2001.

ATA, along with the Pennsylvania Motor Truck Association, the New Jersey Motor Truck Association and Roadway Express, now part of YRC Worldwide Inc., filed suit in 2002, seeking a return to $2.25 per-axle tolls from current $2.75 per-axle levels, AP said.



The appeals court upheld a 2005 decision by lower courts to dismiss the suit on grounds that federal law did not create “a private cause of action” to allow the industry to challenge the toll hike.
