Carriers Appeal STB's Decision
The Surface Transportation Board's Friday decision to impose a 15-month moratorium on rail mergers has been appealed in federal court by Burlington Northern Santa Fe and Canadian National Railway, which want a prompt review as well as a stay that would compel STB acceptance of the two railroads' merger application.CN President and CEO Paul M. Tellier said the board is "protecting competitors, not rail competition" by using other railroads' service problems as a reason to block a merger by "the two most efficient railroads in North America."
The Western Coal Traffic League will appeal the ruling, raising the issue of whether STB has the authority to prohibit mergers, and the appeal may be joined by other shipper organizations. Journal of Commerce (03/21/00) P. 1; Kaufman, Lawrence H.
