Court Sets Oral Arguments in Navistar SCR Lawsuit

The U.S. Court of Appeals for the District of Columbia set oral arguments for May 10 in Navistar’s lawsuit over the federal government’s certification of engines using selective catalytic reduction technology to meet new diesel engine emissions standards.

Navistar’s lawsuit alleges the U.S. Environmental Protection Agency failed to properly comply with federal regulatory procedure when issuing guidance allowing for the use of SCR to meet the 2010 emissions standards.

Besides the setting of arguments, the court was petitioned by the California Air Resources Board to file an amicus brief on behalf of EPA.

In a counter filing, Navistar said that it opposed CARB’s entry into the lawsuit.
