Oregon’s Flat-Fee Truck Tax Will Stand, High Court Says

he U.S. Supreme Court said Monday it will not hear a dispute about how Oregon taxes trucks, letting an existing flat-fee tax system stand, the Associated Press reported.

The high court’s decision keeps in place an Oregon law that allows some carriers to pay flat fees instead of a tax based on vehicle weight and miles traveled, AP reported.

American Trucking Associations had argued that Oregon’s taxes unconstitutionally discriminate against interstate truckers by giving breaks to local haulers of wood, sand and gravel.



ATA had filed a petition with the court in March seeking the Oregon Supreme Court’s rejection of ATA’s challenge to the weight-distance tax system. (Click here for previous coverage.)

The Oregon court's December ruling spared the state from refunding tens of millions of dollars to truckers, AP reported.

Under weight-mile taxes, heavier trucks that cause the most road damage must pay higher taxes, AP said.
