ow could anyone be surprised by the court’s decision that the Federal Motor Carrier Safety Administration must vacate and then review the current hours-of-service rules for drivers?

All anyone needed to do was to compare the notices of proposed rulemaking (NPRMs) to the actual changes. They were not even close.

I have stated before that the new rules were no more difficult to live with than the old — and in some cases were made even easier to beat. When the new rules were first published I was surprised at how the HOS changes seemed to favor the industry over the NPRMs.



I suppose that will now be the point to be addressed. You can bet that if there is, in fact, a rewrite of the HOS regulations, the favor will for sure go the other way.
