DuPont Sues NS Over Poor Rail Service

DuPont Co. sued Norfolk Southern railroad because of service difficulties in the wake of NS’s purchase of a part of the former Conrail.

The Wilmington, Del.-based chemical company alleges that the Norfolk, Va.-based railroad breached its contract to provide DuPont with timely, uninterrupted and reliable service.

In the lawsuit, filed Sept. 1 in U.S. District Court in Alexandria, Va., DuPont said the railroad’s service problems cost the company millions of dollars.

The company said because of service failures it had to secure other modes of transportation, including truck and barge, and it had to use substitute suppliers. That resulted in additional costs and time delays, the company alleged.
