Drug and Alcohol Clearinghouse Rule Gains White House Approval

The White House Office of Management and Budget on Oct. 31 completed its review of the final Commercial Drivers’ License Drug and Alcohol Clearinghouse rule. The rule is scheduled to be published in the Federal Register on Nov. 23, according to the most recent Department of Transportation Significant Rulemakings report.

The rule would create a database for verified positive controlled substances and alcohol test results for commercial driver license holders and refusals by drivers to submit to testing.

It also would require employers of CDL holders and third-party service agents to report positive test results and refusals to test into the clearinghouse.

Employers would be permitted, with a prospective drivers’ consent, to check the clearinghouse before making a hire.



Also, the rule is intended to ensure that employers are meeting their drug and alcohol testing responsibilities.

The rule is a requirement included in the MAP-21 transportation law.
