Court Asked to Assign HOS Case to Same Panel

ttorneys representing Public Citizen filed a motion asking that its challenge to current hours-of-service rules for truck drivers be judged by the same panel that overturned the prior regulation.

Meanwhile, attorneys for the Federal Motor Carrier Safety Administration asked to have the two challenges to the HOS rules — Public Citizen’s and a separate one by the Owner-Operator Independent Drivers Association — by heard by the same panel of judges.

Public Citizen said in its April 6 motion with the U.S. Court of Appeals for the District of Columbia that “judicial economy, efficiency and consistency” favor assigning the case to the same panel of judges that heard the first petition.
