ATA Fights Fees in New Mexico

Two annual fees that New Mexico imposes on trucking could disappear if a lawsuit filed by American Trucking Associations succeeds.

ATA has gone to court, arguing that a $6-per-truck weight-distance tax identification fee and a $250 hazardous materials transporter fee discriminate against interstate carriers and are therefore unconstitutional.

ATA’s Litigation Center an-nounced plans to fight the fees in November (11-8, p. 1).

To challenge the fees, state law first required the trucking group to try to get a refund by filing an administrative claim against the state.
