Agencies Near Deadline on Response in HOS Case

he Federal Motor Carrier Safety Administration planned to work with Department of Justice lawyers right up to an Aug. 30 deadline for filing the government’s response to a court decision that threw out FMCSA’s revised hours-of-service rules, an agency spokesman said Aug. 25.

The truck safety agency planned to announce its response Aug. 30. “They are going to be working all weekend,” said spokesman David Longo.

A Justice Department attorney and a lawyer for American Trucking Associations said they thought it was most likely FMCSA would ask for a stay of the order, giving the agency time to work out a solution acceptable to the court.
