Supreme Court to Consider Mexican Truck Program Appeal Jan. 10

The U.S. Supreme Court is scheduled to announce by Jan. 13 whether it will review an appeals court decision that upheld the Federal Motor Carrier Safety Administration’s authority to operate a cross-border pilot program with Mexico.

The high court is scheduled on Jan. 10 to confer and vote on the petition in which the Owner-Operator Independent Drivers Association argued that Mexican drivers should not be permitted to travel beyond the U.S. commercial trade zone without a United States commercial driver license.

The Oct. 24 petition was lodged in response to a federal appeals court ruling in July saying the cross-border program could continue after OOIDA and the Teamsters union brought the lawsuit because they said Mexican drivers lacked the qualifications to be in the program.

So far, 14 Mexican carriers have either permanent or provisional authority to participate in the program.
