Owner-Operator Ruled 'Employee' Under Nevada Law

The Nevada Supreme Court ruled that an individual contractor was eligible for worker compensation as an employee of the company he contracted with.

Similar rulings are unlikely elsewhere. The Nevada Supreme Court stated in its September decision that the state law on which the ruling was based was “uniquely different” from other states.

The court denied the appeal by a Delaware-based distribution management company licensed to do business in Nevada and upheld a lower state court finding that an independent owner-operator of a Las Vegas trucking business was an employee of the company he contracted with and eligible for workers’ compensation under state law.
