FMCSA Proposes to Accept Modifications to Carrier, Driver Violations

The Federal Motor Carrier Safety Administration on June 3 announced proposed changes to its inspection data system that will accept modifications to motor carrier or driver citations and violations that a court has dismissed or issued a finding of not guilty.

The agency’s Motor Carrier Management Information System has not permitted records to be corrected once citations or roadside inspection violations are posted.

“The adjudication results will impact the use of roadside inspection violation data in other FMCSA data systems,” the agency announcement said. “These changes are intended to improve roadside-inspection data quality.”

FMCSA said individuals must submit certified documentation of adjudication results through a Request for Data Review in FMCSA’s DataQs system to initiate this process.

“The MCMIS is being modified to accept adjudication results showing that a citation was dismissed or resulted in a finding of not guilty; resulted in a conviction of a different or lesser charge; or, resulted in conviction of the original charge,” FMCSA said.
