he Transportation Security Administration issued a proposed rule Wednesday and would soon issue a interim final rule implementing several aspects of the background check requirements for drivers with hazardous materials endorsements, American Trucking Associations said.

The rules would require the states to indicate whether they would collect and transmit driver fingerprints or whether they would allow the designated TSA contractor to perform those functions. ATA said the rules also proposed the fees to be charged in connection with the background checks.

ATA said it expected these fees to be between $83 and $103 in states that select the TSA contractor to collect fingerprints.

The fees assessed in states that perform the fingerprint collection function themselves would probably be higher, as the rule did not establish a ceiling on the state-based fingerprint collection fees, ATA said.
