Under the proposed Motor Carrier Fuel Cost Equity Act, independents would get reimbursed “when the weekly average price of diesel fuel for that week surpasses the 52- week average by more than 5 cents,” based on figures from the Energy Information Administration.

Sponsors of the legislation said independents lacked the weight to get compensated for the burden of high fuel prices and had to take what they were offered by the carriers if they wanted to work. The legislation obligates carriers to pass the surcharge on to shippers. The bill stipulates that independent drivers have no right of action against the shippers.
